Terms of Service

Welcome to UELLOSEND (referred to herein as "UELLOSEND", "Quizaa", "we", "our", or "the Platform"), operated by UviTech Inc. By creating an account, accessing our websites (including uellosend.com), using our APIs, hosting or participating in interactive quiz sessions, voting via Smart Cast, purchasing event passes, or sending SMS messages, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, you must immediately discontinue using our services. If you are entering into these Terms on behalf of a company, educational institution, non-profit, or other legal entity, you represent and warrant that you have the full legal authority to bind that entity.

Age Requirements

• General Gameplay (Players): Must be at least 13 years old (or the legal age of digital consent in your jurisdiction).
• Creators, Hosts & SMS Account Owners: Must be at least 18 years old or possess legal majority to enter binding commercial agreements, purchase credits, or configure payout accounts.

To access creator studios, host live games, manage Smart Casts, publish events, or dispatch bulk SMS campaigns, you must register for an authenticated account via our verified Supabase authentication service.

• Accuracy of Information: You agree to provide accurate, current, and complete registration details and maintain updated contact information.
• Credential Confidentiality: You are solely responsible for maintaining the confidentiality of your account password, email access, and API secret keys.
• API Key Security: SMS API keys grant programmatic credit-spending authority. You agree never to expose secret keys in client-side code, public repositories, or unsecured environments. Any API calls authenticated with your key are deemed authorized by you.
• Notification of Breach: You agree to notify us immediately at security@uellosend.com upon suspecting unauthorized account access.

UELLOSEND Quizaa provides real-time multiplayer interactive trivia experiences for classrooms, corporate events, and stadium arenas.

• Server-Authoritative Timing: All question countdowns, answer submission timestamps, and latency calculations are strictly adjudicated on the server to ensure competitive fairness.
• Zero-Knowledge Answer Privacy: Correct answers are never transmitted to client devices during the active countdown window, preventing client-side inspection exploits.

AI Question Generation: When using our AI Quiz Draft tools (powered by Google Gemini, Anthropic Claude, and OpenAI), creators remain responsible for reviewing question accuracy, factual validity, and curriculum appropriateness prior to hosting live sessions.

Smart Cast facilitates verified audience choice voting for pageants, award ceremonies, talent shows, and live television broadcasts via both web checkout and telecommunication USSD channels.

• Immutability of Cast Votes: Once a vote is successfully processed and confirmed by the payment gateway or telco carrier, it is recorded in the immutable audit ledger and cannot be cancelled, edited, or refunded.
• Anti-Fraud Telemetry: We employ real-time device fingerprinting, IP velocity rate-limiting, and MoMo reference deduplication to prevent automated bot voting or vote-stuffing.
• Organizer Obligations: Contest organizers agree to clearly disclose contest deadlines, voting fees, and category rules to voters. Rigging, manipulating contestant listings after public voting commencement, or misrepresenting results constitutes a material violation resulting in account termination and legal referral.

Our Event Pass management engine provides digital ticket generation, cryptographic QR scan verification, and organizer revenue ledger tracking.

• Pass Validity & Single-Entry Check-in: Each digital event pass contains a cryptographically signed QR code. Once scanned by the organizer's verified scanner, it is invalidated for subsequent entries.
• Event Postponement or Cancellation: Event organizers bear full legal and financial responsibility for their events. In the event of cancellation, organizers must issue full refunds to passholders through our platform or their designated payment account.
• Organizer Ledger Payouts: Ticket revenue collected on behalf of organizers (minus standard platform processing fees) is credited to the organizer's digital ledger and disbursed according to agreed settlement cycles upon KYC verification.

UELLOSEND provides high-throughput A2P (Application-to-Person) bulk SMS services across major mobile network operators (MTN, Telecel, AT, etc.).

• Sender ID Registration: Custom Alpha-Numeric Sender IDs (up to 11 characters) require manual administrative verification and proof of business registration before activation.
• Credit Expiration Rules: Standard Pay-As-You-Go SMS credits do not expire. Promotional or discounted SMS Bundles remain valid for 90 calendar days from the date of purchase, after which unused bundle units expire.
• Carrier Delivery: While we guarantee immediate submission to carrier SMSCs, delivery to the handset is subject to recipient device availability, roaming status, and network coverage.

All online payments are securely processed using PCI-DSS Level 1 certified gateways (including Paystack) supporting Mobile Money (MTN, Telecel, AT), Visa, Mastercard, and bank channels.

• Multi-Currency Pricing: Displayed prices in GHS, NGN, KES, USD, GBP, and EUR are calculated according to live exchange rates or preset commercial tier schedules.
• Subscription Renewals: Host Pro, Enterprise, and School subscription tiers automatically renew at the end of each billing cycle unless cancelled prior to the renewal date via account settings.
• Refund Policy: Subscription fees, AI credit bundles, voting transactions, and dispatched SMS fees are non-refundable once activated or consumed, except where mandated by applicable consumer protection laws.

Your Content: You retain full ownership and copyright of all quiz questions, contestant profiles, event banners, and media you upload to UELLOSEND. By uploading content, you grant UELLOSEND a worldwide, non-exclusive, royalty-free license to host, store, display, and transmit your content solely for the purpose of operating the services.

Platform Property: The UELLOSEND brand, logos, procedural audio synthesizer engine, and UI designs are proprietary property of UviTech Inc. The traditional Ghanaian Adinkra symbols used throughout the platform are public domain cultural heritage rendered in custom vector formats.

Copyright Infringement / DMCA Takedown Notice: If you believe content hosted on our platform infringes your copyright, send a formal notice to legal@uellosend.com including proof of ownership and the exact URL of the material.

"AS IS" Disclaimer: UELLOSEND is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that gameplay will be uninterrupted, error-free, or that telecommunication networks will deliver 100% of SMS messages without carrier delay.

Cap on Liability: To the maximum extent permitted by applicable law, in no event shall UELLOSEND, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages. Our aggregate liability for all claims under these Terms shall not exceed the amount paid by you to UELLOSEND in the twelve (12) months preceding the claim.

Termination: We reserve the right to immediately suspend or terminate your account without notice if you breach these Terms, engage in fraudulent transactions, or abuse our messaging or voting infrastructure.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law provisions.

In the event of any controversy or claim arising out of or relating to these Terms, the parties agree to first attempt to resolve the dispute informally by contacting legal@uellosend.com. If the dispute cannot be settled within 30 days, it shall be resolved by binding arbitration.
